  Why is this called SPAM? SPAM is unsolicited e-mail. This is either fraud, copyright infringement or both. Perhaps this is why the suit doesn't stand a chance.

  Hopefully this suit will flush out an even bigger "fish": requiring email providers to readily identify all scam and phishing scheme perpetrators with their registered name and information, making it easier to track them down.
