George, I wonder if you could share with us what states you stopped lending in?

George L. Engelke, Jr. – Chairman and Chief Executive Officer

I don't really have that list with me, to be very honest, Mark.

Mark T. Fitzgibbon - Sandler O'Neill & Partners

Okay. It presumably was some of the markets that get written a lot about?

George L. Engelke, Jr. – Chairman and Chief Executive Officer

Yes, absolutely. I would say, you know, like Michigan and Ohio come to mind, I know we have that, but I really don't know which were the ones.

Monte N. Redman - President and Chief Operating Officer

Yes, Michigan and Ohio, we actually stopped earlier in the year, including Florida. A lot of the states we just stopped lending weren’t doing a lot of business and it wasn’t really reflective of our portfolio, it’s really reflective of information we are hearing around our state. So, we are lending in 29 states and in 22 of those states of the 29, we are actually doing broker business as well.

And then secondly with your tangible capital ratio getting pretty close to your target, are there any plans to raise some hybrid capital perhaps to able to buy back the stock if the environment remains difficult to support the price?

George L. Engelke, Jr. – Chairman and Chief Executive Officer

We always look at opportunities, if it makes sense for us to do those kinds of things, we will, but we really don’t have anything on docket at the moment.

Okay. And then just a technical question on expenses. I think in the press release this quarter, you mentioned there were some goodwill litigation costs. Could you bring out for us how much that was and maybe give us a sense for what we should expect in the first quarter, will a lot of that go way now that some of the trails are behind?
